By registering for an online account with Ascot Lane, the user selects a Login ID and Password for their own use and will not share the Login ID and Password with anyone else. Ascot Lane will not be held responsible for the Login ID and password being accessed by people other than the Registered User.
Ascot Lane may decline a request for registration for an online account at its discretion or where insufficient evidence is provided by the applicant that they are a registered business with a genuine interest in the craft industry and on–selling our products to the public or using Ascot Lane products as part of their business.
The Registered User will keep their personal details up to date, should they need to be changed. Orders raised through the Ascot Lane website will be sent to the address received on the online order and Ascot Lane will not be held responsible for the non–receipt of orders should the Registered User's personal information be incorrect.
Forgotten Passwords and Login ID's can be retrieved from the Ascot Lane website and will be sent to the email address nominated upon first registration of the online account. Should the email address be changed, the Registered User must contact Ascot Lane Head Office to have this information updated on the database.
Ascot Lane reserves the right to cancel or deactivate an online account of a Registered User where there has been misuse or abuse of information in the website or where the Registered User is no longer a registered business with a genuine interest in the craft industry and on–selling our products to the public or using Ascot Lane products as part of their business.
An order placed through the Ascot Lane website shall be deemed to be a valid order for the Registered User, meaning that the goods ordered are required by the Registered User and the order is a request for Ascot Lane to send and invoice the goods to the Registered User.
If any dispute arises concerning any order (and including any question of identity or authority or any phone, fax or computer generated order) the internal records of Ascot Lane shall be conclusive evidence of what was ordered.
Ascot Lane will not be held responsible for the Registered User ordering an item(s) from the Ascot Lane website that is not required by the Registered User. Ascot Lane has ensured that the order codes, images and descriptions on the Ascot Lane website match the actual products.
Should the Registered User be on a prepaid basis, Ascot Lane will email a quote to the Registered User listing the goods from the order that can be supplied upon payment of the total quote amount. The goods will be reserved for 1 week from the date of the quote for the Registered User to remit the quote amount to Ascot Lane. Thereafter, the goods will be unreserved and made available for other orders. Responsibility rests upon the Registered User to request a requote after one week of the quote being issued. If payment is made after one week from the date of the quote, Ascot Lane will send all items in stock and place other items on backorder. Any credits that arise will be applied to the supply of the backordered goods.
Each order the Registered User places shall be and be deemed to be a representation by it made at the time that the Registered User is solvent and able to pay all of its debts as and when they fall due.
The Registered User agrees: a) not to cancel any order placed without prior approval from Ascot Lane; b) not to return goods without prior approval from Ascot Lane and if goods are not in brand new and unused condition with undamaged packaging and if 3 weeks or more have passed since delivery; c) that Ascot Lane may take back goods in saleable condition on such terms as Ascot Lane considers to be reasonable; d) to pay to Ascot Lane on request a restocking fee of 10% of the gross invoice value of all returns; e) not to return goods without first providing to Ascot Lane an original invoice as proof of purchase; f) not to return any goods which have been custom made, custom processed or custom acquired; g) Ascot Lane does not give cash refunds.
Postage will be added to the order amounts. All orders will be charged postage.
Ascot Lane may supply by instalments and/or withhold or cancel supply where: (a) Ascot Lane has insufficient goods to fulfil orders; (b) goods are not available to supply, for example, the goods are yet to be released or printed; (c) the Registered User is on credit account and overdue monies are owing; and/or (d) Ascot Lane considers it appropriate whether because of any minimum invoice policy or otherwise.
The Registered User agrees that: (a) Ascot Lane accepts no responsibility or duty for delivery but may elect to arrange delivery at its discretion and without any liability and at the cost and responsibility of the Registered User in all things; (b) the Registered User shall be deemed to have accepted delivery and liability for the goods immediately upon Ascot Lane notifying the Registered User that any goods are ready for collection or upon Ascot Lane delivering any goods to a carrier or to the business premises of the Customer or site whether attended or not; (c) a certificate purporting to be signed by an officer of Ascot Lane confirming delivery shall be conclusive evidence of delivery as shall any signed delivery docket; (d) Ascot Lane shall not be liable for delay, failure or inability to deliver any goods.
The prices listed on the Ascot Lane website are current for goods held in stock and those prices will remain firm for the supply of orders to Registered Users.
Prices for goods that are future releases (i.e. at the time of ordering the goods are yet to be released) are based upon the information that Ascot Lane has on hand at the time of listing on the Ascot Lane website and are deemed to be indicative only. As the date approaches for the release of items, the price may change and as such the order dollar amount will be amended.
All prices shown on the Ascot Lane website are exclusive of GST, unless otherwise indicated.
Payment is to be made by cheque, bank cheque, credit card (Visa or Mastercard only) or EFT without deduction.
For Registered Users on credit account with Ascot Lane, the invoice shall be settled in full by the end of the month of the invoice month. For example, if the invoice has been raised in March, the full amount of the invoice is to be paid by 30 April. Failure to settle the invoice by its due date will result in the Registered Users account being placed on hold, with no further supply of goods from Ascot Lane, and penalty interest being applied to the amount owing at a rate outlined in the Penalty Interest Rates Act (Vic) rate plus 2% from the date that the invoice is due. Any freight charged by Ascot Lane is to be included within the settlement of the supply of goods.
The Registered User agrees to limit any claim to the cost of replacement of goods or supply of equivalent goods and/or services.
Ascot Lane shall not be liable in any way for: (a) any claim, loss or expense arising which is made after 7 days from the date of delivery of goods and/or services (or at all once goods have been unpacked, on–sold or otherwise used or applied) – after which there shall be deemed to have been unqualified acceptance; (b) any contingent, consequential, direct or indirect, special or punitive damages arising in any way and whether due to the negligence of Ascot Lane or otherwise; (c) any claim relating to any alleged fault or defect in any way caused or contributed to by the Registered User and/or any third party.
No other term, condition, agreement, warranty, representation or understanding whatsoever whether express or implied, in any way extending to, otherwise relating to or binding upon Ascot Lane other than these Terms is made or given.
By ordering from the Ascot Lane, whether via online, using the Express Order Form or by any other means, the User accepts to be bound by the trading terms and conditions listed above.
